3.3 Incomplete Notices
DMCA notices that do not comply substantially with the requirements outlined above may not be effective and may result in a delay in processing your complaint.
4. Counter-Notification Procedure
4.1 Counter-Notice Process
If material you have posted to our website has been taken down as a result of a DMCA notice, you may file a counter-notification if you believe the material was removed as a result of mistake or misidentification. To file a counter-notification with us, please provide the following information:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Today In The History may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
4.2 Submission of Counter-Notices
Counter-notices should be submitted to our DMCA Compliance Officer using the contact information provided above.
4.3 Response to Counter-Notices
Upon receipt of a valid counter-notice, we will promptly forward a copy to the person who filed the original DMCA notice. If we do not receive notice within 10 business days that the original complainant is seeking a court order to prevent further infringement of the material at issue, we will replace or cease disabling access to the material that was removed.
5. Repeat Infringer Policy
5.1 Policy Statement
In accordance with the DMCA and other applicable laws, Today In The History has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5.2 Definition of Repeat Infringer
A “repeat infringer” includes any user who has been the subject of more than two DMCA notices that are not successfully challenged with a counter-notification.
6. Accommodation of Standard Technical Measures
